These terms apply when you use heretotrain.com.au (the "site") or buy from us. The site is run by Callipari-Perrett Pty Limited, ACN 638 492 976, ABN 15 638 492 976, trading as HTT · Here To Train ("we", "us"). Contact: heretotrainhq@outlook.com · 88 Uplands Terrace, Wynnum QLD 4178

1. Your rights under the Australian Consumer Law come first

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded. If anything in these terms seems to say otherwise, the law wins.

2. Ordering

Placing an order is an offer to buy. A contract is formed when we confirm your order by email.
We may decline or cancel an order before printing (for example, a pricing error, stock that's unavailable, or suspected fraud). If we do, we'll refund everything you paid.
You must be 18 or over, or have a parent or guardian's permission, to place an order. Designs in our Explicit collection contain strong language and are intended for adults.

3. Prices and payment

All prices are in Australian dollars (AUD).
Prices include GST. A tax invoice is included with your order confirmation, or available on request.
Postage is shown separately at checkout and included in the total before you pay.
We don't charge card payment surcharges.
If a price is wrong on the site, we'll either honour the lowest displayed price or contact you before processing and let you cancel for a full refund.
Payment is taken at checkout through our payment provider. We don't see or store your full card number.

4. Discount codes, team orders and the monthly draw

Discount codes apply to the item total, not postage, and can't be combined with other codes unless we say so.
Team orders: 10 or more items in one order get 10% off the item total at checkout. Not with other codes.
The monthly tee draw has its own terms and conditions.

5. Our designs

The slogans, designs, logos and artwork on this site belong to us. You can't copy them, sell them or use them commercially without our permission.

Our designs are humour about gym habits. HTT · Here To Train is not affiliated with, endorsed by or connected to any gym, gym chain, fitness business or creator. Two designs contain explicit language; they are grouped in the Explicit collection and marked 18+.

6. Colours, sizes and images

We try to show colours and prints accurately, but screens vary and printed colours can look slightly different from a preview. Product images are digital mock-ups until our sample photos are in. Small variations in print placement (about 2 cm) and garment measurements (about 2 cm) are normal for made-to-order garments and are not faults. A print that's clearly misplaced or the wrong colour is a fault, and you're covered. Please check the size guide before ordering: our Oversized fit runs big.

7. Delivery, refunds and returns

8. Using the site

You agree not to misuse the site, for example by interfering with its security or operation, uploading malware, scraping it, or using it for anything unlawful. We may change or take down the site, or any product, at any time. Links to other sites are for convenience only. We're not responsible for their content.

9. Our liability

We're responsible for losses caused by our failure to meet the consumer guarantees or these terms, as set out in the Australian Consumer Law. That includes losses that were reasonably foreseeable. Apart from that, and to the extent the law allows, we're not liable for losses that aren't reasonably foreseeable, or that are caused by things outside our reasonable control.

11. Changes to these terms

We may update these terms from time to time. The version on the site when you place your order applies to that order. Later changes don't affect orders already placed.

12. Governing law

These terms are governed by the law of Queensland. This doesn't stop you from relying on the consumer protection laws of the state or territory where you live, or from making a claim in your own state or territory's courts or tribunals.
